Eligibility Criteria for Patent Application 

Beyond novelty, inventiveness, and industrial applicability, the subject matter of a patent application must not fall into any of the following categories: 

- Scientific discoveries

- Animal and plant varieties (though production methods may be patentable)

Application Timeline 

- Invention Patents: Typically take 2 to 4 years from filing to grant due to substantive examination procedures. 

- Utility Model and Design Patents: Generally granted within 6 to 12 months as they undergo only formal examination. 

Hiring a Registered Patent Agent 

Foreign applicants without a domicile or place of business in China must appoint a registered Chinese patent agency to represent them. 

Review of a Rejected Application
